Terms of Service

1. Acceptance of Terms
Dungeons & Moles ("the Game", "we", "us") is developed and operated by Ailton Sávio Sacramento Júnior, an individual based in Brazil. By signing in to, or otherwise using, the Game through the Android app or the web client at app.dungeonsandmoles.com, you agree to these Terms of Service ("Terms") and to our Privacy Policy. If you do not agree, do not use the Game.
2. Eligibility
3. Description of Service
Dungeons & Moles is a fully on-chain PvE roguelike dungeon crawler built on the Solana blockchain. The Game includes:
- PvE Campaign: Seeded dungeon exploration with auto-resolving combat, POI interactions, and weekly boss fights
- PvP Modes: Gauntlet, Duels, and Pit Draft competitive modes
- NFT Marketplace: Trading of in-game items as on-chain assets
- Guest Mode: A local-only experience that does not require a wallet or blockchain interaction
All gameplay logic executes on-chain via Solana smart programs and MagicBlock Ephemeral Rollups. The Game uses Verifiable Random Functions (VRF) to ensure provably fair randomness.
4. Account and Wallet
4.1 Wallet-Based Authentication
The Game uses Solana wallet-based authentication exclusively. We support Phantom, Solflare, and Backpack wallets. There are no traditional accounts with usernames and passwords.
4.2 Wallet Security
You are solely responsible for:
- Maintaining the security of your wallet, seed phrase, and private keys
- All activity that occurs through your connected wallet
- Any losses resulting from unauthorized access to your wallet
We never have access to your wallet private keys or seed phrase. We cannot recover your wallet or reverse transactions if your wallet is compromised.
4.3 Session Keys
During gameplay, the Game creates temporary session keys derived from your wallet signature. These session keys sign in-game transactions on your behalf so you do not need to approve each individual action. Session keys are:
- Derived deterministically from your wallet signature
- Stored securely on your device (Expo SecureStore on native, sessionStorage on web)
- Limited in scope to in-game actions only
- Temporary and cleared when the session ends
You are responsible for the security of the device on which session keys are stored.
5. Payments and Transactions
5.1 Cryptocurrency Payments
All payments in the Game are made in SOL or SPL tokens on the Solana blockchain. Current pricing:
- PvE Campaign Runs: 0.05 SOL for 20 runs (with 20 free runs on profile creation)
- Gauntlet Entry: 0.01 SOL per run
- Duels Stake: 0.1 SOL per match
- Pit Draft Stake: 0.1 SOL per match
- NFT Marketplace: Variable SOL amounts set by sellers
Prices are subject to change. Changes will be reflected in the Game interface before you confirm any transaction.
5.2 In-Game Wallet
Starting a session funds a session signer (your in-game wallet) from your main wallet, currently about 0.09 to 0.10 SOL, to pay account rent and network fees. Excess funds above the cap are returned automatically, and you can withdraw the balance through the profile menu when no session is active. SOL spent on rent for a session that gets stuck may not be recoverable.
5.3 Prize Pools, Rewards and Events
Gauntlet entry fees, part of PvP stakes, run-pack purchases and marketplace trades fund on-chain prize pools, paid out by the on-chain programs as described in the Game's documentation. Events may award cosmetic items such as skins. Unless we say otherwise in writing:
- Rewards are set by the on-chain programs and the published event rules, and may be changed or cancelled for future events
- We may withhold or reverse the effect of rewards obtained through bugs, exploits, bots or multiple accounts, where technically possible
- Devnet rewards have no monetary value and may not carry over to mainnet
- Paid competitions with prizes are regulated differently in different countries. It is your responsibility to make sure taking part is legal where you live, and we may restrict them in some regions
5.4 No Refunds
This includes:
- Entry fees and run purchases
- PvP stakes (win or lose)
- NFT marketplace purchases
- Any other SOL or token transfers made through the Game
By initiating a transaction, you acknowledge and accept that it is irreversible.
5.5 Transaction Fees
Solana network transaction fees (rent, gas) are paid by you or by the Game's session funding mechanism. These fees go to the Solana network, not to us.
5.6 No Fiat Currency
The Game does not accept or process fiat currency (USD, BRL, EUR, etc.) in any form. We do not process credit card, bank transfer, or any traditional payment method.
6. Game Status
Specifically:
- Transition to mainnet will be announced in advance
- Progress on devnet may or may not carry over to mainnet
- We make no guarantees about the timeline or nature of future releases
7. On-Chain Data and Immutability
All game state, transactions, and interactions are recorded on the Solana blockchain. This data is:
- Public: Anyone can view your wallet address, transactions, game progress, items, and match results
- Permanent: Blockchain data cannot be deleted, modified, or made private
- Transparent: All game logic is executed by on-chain programs that can be inspected
By using the Game, you consent to having your gameplay data stored publicly and permanently on the blockchain.
8. Fairness and Randomness
The Game uses Verifiable Random Functions (VRF) provided by on-chain oracles to generate randomness for map generation, combat, POI outcomes, and other game mechanics. VRF provides cryptographic proof that randomness was generated fairly.
While we use VRF to ensure fair randomness, we do not guarantee any particular outcome, win rate, or return on your SOL expenditure. The Game is a skill-and-chance-based experience, and losses are a normal part of gameplay.
9. Acceptable Use
You agree not to:
- Use the Game if you are under 18 years old
- Attempt to exploit, hack, or manipulate on-chain programs or game mechanics
- Use bots, scripts, or automated tools to gain an unfair advantage
- Engage in market manipulation on the NFT marketplace
- Harass, threaten, or abuse other players
- Use the Game for money laundering or any illegal activity
- Attempt to interfere with or disrupt the Game's infrastructure
- Reverse engineer, decompile, or create derivative works from the Game client (except as permitted by applicable open-source licenses)
- Misrepresent your identity or impersonate another person
Violation of these terms may result in suspension or termination of your access to the Game.
10. Notifications and Analytics
If you allow them, the Android app sends reminders and event news. You can turn them off in Settings or in your phone's settings. The Game collects play analytics and error reports as described in the Privacy Policy; you can turn play analytics off with Share play data in Settings.
11. Intellectual Property
11.1 Our Rights
All original content in Dungeons & Moles, including but not limited to artwork, music, sound effects, game design, UI design, story, character designs, and the Game client software, is the property of Ailton Sávio Sacramento Júnior and is protected by copyright and other intellectual property laws. All rights are reserved unless explicitly stated otherwise.
11.2 Open Source Components
The Game incorporates open-source software components licensed under their respective terms (MIT, Apache 2.0, BSD, and others). These components remain subject to their original licenses. A list of major open-source dependencies is available in the Game's package manifest.
11.3 Your Content
Your display name and gameplay data are stored on-chain. You retain no intellectual property rights over game state data, as it is generated by the Game's deterministic engine.
11.4 On-Chain Assets
NFT items you own in the Game are on-chain assets on the Solana blockchain. Ownership of the on-chain token does not grant you intellectual property rights over the underlying artwork or game design associated with that item.
12. Disclaimer of Warranties
To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:
- Merchantability or fitness for a particular purpose
- Uninterrupted, error-free, or secure operation
- Accuracy or reliability of any game content or on-chain data
- Compatibility with your device, wallet, or network
- Availability of the Solana network, Ephemeral Rollups, or any third-party service
We do not warrant that the Game will be available at all times. Downtime may occur due to maintenance, Solana network congestion, Ephemeral Rollup infrastructure issues, or other factors beyond our control.
13. Limitation of Liability
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of SOL, tokens, or other cryptocurrency
- Loss of NFTs or in-game items
- Loss of game progress or data
- Financial losses from PvP stakes or marketplace trades
- Damages resulting from wallet compromise or session key exposure
- Damages resulting from Solana network failures or congestion
- Damages resulting from third-party service outages (MagicBlock, Helius, Sentry, etc.)
- Damages resulting from smart contract bugs or vulnerabilities
You acknowledge that cryptocurrency and blockchain gaming involve inherent financial risk, and you assume full responsibility for any losses incurred.
Nothing in these Terms excludes or limits rights you have under consumer protection laws that cannot be waived by contract, including the Brazilian Consumer Defense Code (Lei 8.078/1990) where it applies.
14. Indemnification
To the extent permitted by law, you agree to cover any claims, losses or costs (including reasonable legal fees) that we incur because you broke these Terms, broke the law, or infringed someone else's rights while using the Game.
15. Force Majeure
We shall not be liable for any failure or delay in providing the Game due to causes beyond our reasonable control, including but not limited to: Solana network outages, blockchain congestion, Ephemeral Rollup infrastructure failures, internet disruptions, natural disasters, government actions, pandemics, or any other force majeure event.
16. Termination
16.1 By You
You may stop using the Game at any time. Your on-chain data will remain on the blockchain permanently.
16.2 By Us
We may suspend or terminate your access to the Game at any time, with or without cause, and with or without notice. Grounds for termination include but are not limited to violation of these Terms or any conduct we deem harmful to the Game or its community.
16.3 Effect of Termination
Upon termination, your right to access the Game client ceases. Your on-chain data, including any NFTs and game state, remains on the Solana blockchain and is not affected by termination of access to our client application.
17. Governing Law and Dispute Resolution
17.1 Governing Law
These Terms are governed by and construed in accordance with the laws of the Federative Republic of Brazil, without regard to conflict of law principles.
17.2 Dispute Resolution
Any dispute arising from or relating to these Terms or your use of the Game shall first be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the competent courts of Brazil. If you are a consumer, you may also bring a claim in the courts where you live when the law gives you that right.
17.3 Class Action Waiver
To the extent permitted by applicable law, you agree to resolve disputes on an individual basis and waive any right to participate in a class action, collective action, or representative proceeding.
18. Changes to These Terms
We may update these Terms at any time. Changes will be posted at docs.dungeonsandmoles.com/legal/terms with an updated "Last Updated" date. Continued use of the Game after changes constitutes acceptance of the revised Terms. For material changes, we will make reasonable efforts to notify users through the Game interface.
19. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
20. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Ailton Sávio Sacramento Júnior regarding your use of Dungeons & Moles.
